The Delhi High Court has sentenced advocate Gulshan Pahuja to six months of imprisonment in a contempt of court case over remarks allegedly referring to the judiciary as functioning under a “dictatorship.” The Court observed that such statements were not only scandalous in nature but also had the potential to undermine public confidence in the judicial institution.

While passing the order, the Bench noted that members of the legal profession are expected to maintain respect for the dignity and authority of the courts. The Court held that reckless and derogatory comments against the judiciary cannot be justified under the guise of free speech, especially when they tend to lower the reputation of the institution in the eyes of the public.

The contempt proceedings were initiated after the remarks made by the advocate came to the Court’s attention. During the hearing, the Court examined the impact of such statements on the administration of justice and emphasized that criticism of the judiciary must remain fair, balanced, and within constitutional limits.

The High Court ultimately concluded that the comments crossed the permissible boundary of criticism and amounted to criminal contempt of court. Accordingly, the advocate was sentenced to six months in jail as part of the punishment imposed by the Court. (opindia)
